Man Arrested on Felony Drug Charges After Loud Radio Results in Traffic Stop
Introduction
A Benton probationer, David Chance Rolett, was apprehended in the early hours of Tuesday due to a loud radio in his vehicle. The incident led to his arrest on felony drug charges.
Details of the Arrest
The 26-year-old Rolett, who resides in Benton, was taken into custody at around 1:30 a.m. He now faces felony charges for possession of meth, a controlled substance, as well as possession of drug paraphernalia. If convicted, these charges can result in a maximum prison sentence of six years. Additionally, he received a citation for violating the city’s noise ordinance.
Judicial Proceedings and Prior Convictions
Rolett is currently held on a bond of $5,250. His court appearance is scheduled for December 19 in Garland County District Court. However, if he fails to post bond, he will likely be arraigned before that date. Court records reveal that Rolett has a previous conviction for possession of a controlled substance in Saline County on April 18, 2019. He was sentenced to four years of probation as a result. Furthermore, he also has a prior conviction for possession of drug paraphernalia in Saline County in 2016.
Probable Cause Affidavit
According to the probable cause affidavit, Hot Springs police Sgt. Zach Brown was on patrol around 1 a.m. on Tuesday in the 3300 block of Central Avenue when he heard the sound of “loud amplified bass music” emanating from a motor vehicle. Brown observed a gray Chevrolet Silverado pickup truck heading south on Central Avenue, and the music was clearly audible and disturbing from a distance of approximately 70 yards.
Traffic Stop and Vehicle Search
Sgt. Brown proceeded to follow the vehicle and initiated a traffic stop in the 3500 block of Central Avenue. Although the vehicle slowed down, it continued south, disregarding multiple locations where it could have pulled over. Sgt. Brown repeatedly activated his siren, eventually prompting the vehicle to halt in the 3800 block.
Discovery of Meth and Drug Paraphernalia
Upon approaching the vehicle, Sgt. Brown identified the driver and sole occupant as David Chance Rolett. It was determined that Rolett had a felony record and a search waiver on file. During the vehicle search, Sgt. Brown allegedly found a baggie containing 1.2 grams of a substance that later tested positive for meth. The baggie was concealed in a “diaper wipe container” located just behind the center console. Additionally, a small metal container was discovered after it reportedly fell out of Rolett’s pants leg while he was being placed in the back of Sgt. Brown’s police unit. This container contained another baggy with 0.5 grams of meth. Moreover, a glass pipe with residue, commonly used for inhaling meth, was reportedly found in Rolett’s pocket.
