Local Man Arrested on Multiple Charges after Alleged Attack and Scuffle with Hot Springs Police
Introduction
A resident of Hot Springs, Nathan Bryan McAfee, 41, has been apprehended by the police on felony and misdemeanor charges. The arrest took place on Tuesday morning after an alleged assault on his girlfriend and a neighbor. Furthermore, drugs were discovered in his backpack, leading to additional charges against him.
Charges and Potential Punishments
McAfee has been charged with multiple offenses, including felony possession of a controlled substance (meth) and possession of drug paraphernalia. Each felony charge carries a maximum prison sentence of six years. Additionally, he faces misdemeanor charges of third-degree domestic battery, third-degree battery, and resisting arrest.
Previous Criminal History and Detention
Although McAfee has no prior criminal record in the local area, he is currently being held on a zero bond parole hold. He was scheduled to appear in Garland County District Court on Wednesday.
Incident Details
According to the probable cause affidavit, HSPD Officer James Yerina responded to a complaint regarding threats at a residence on Civic Street at around 8 a.m. Upon arrival, Officer Yerina heard a heated argument coming from the backyard. As he approached the back of the apartment complex, he noticed McAfee, a white male, jumping over a nearby fence.
Officer Yerina intercepted McAfee and attempted to engage him in conversation. However, McAfee appeared agitated, walking in circles in the parking lot and setting down a backpack. He then proceeded to rummage through the bag, despite Officer Yerina’s instructions to stop.
Officer Yerina warned McAfee that he would be detained if he continued to search the backpack. At this point, McAfee’s girlfriend emerged on the porch, and McAfee approached her, pleading for a cigarette on his knees. Officer Yerina instructed McAfee to return to him for further discussion, but McAfee refused and fled on foot towards Convention Boulevard.
McAfee continued his escape by jumping over a 10-foot retaining wall onto Convention Boulevard and running towards Laurel Street. Officers pursued him and eventually apprehended him. Throughout the apprehension, McAfee resisted arrest and refused to comply with commands.
Officer Yerina confirmed that the backpack found in McAfee’s possession during the pursuit was the same one he had observed earlier.
Victims’ Accounts
According to the girlfriend, McAfee assaulted her inside the apartment at approximately 1 a.m. that day, resulting in a laceration on her lower lip both inside and outside.
A neighbor of McAfee also approached Officer Yerina, stating that during an argument over $60, McAfee had punched him on the left side of his forehead, causing a laceration.
Prior Conviction and Parole Status
A check of McAfee’s criminal history revealed a 2014 conviction in Bossier City, Louisiana, for felony possession of a controlled substance. As a result, he was on parole at the time of his arrest.
